This is the very reason my law firm exists. It exists to make sure that people who make a living off their creativity are paid for use of that creativity. If you are an artist, designer, writer, athlete, model, public figure, you make your money off the usage of your work. Don’t kid yourself and say you do it for the sake of the art. You have to eat, too. So, don’t be afraid to go after those who use your work without paying you for it first! If you dont, you are diminishing the true value of your brand/talent/work. Translation: you’re limiting the amount of revenue your bank account could hold.
To the creative folk out there, here’s a secret: the value of your work, talent, and brand is not JUST in how well your brand is marketed or developed. It is not JUST in how great your work and talent are, nor how great and recognizable your brand is. The value is created in how vigorously and strategically you police and enforce your rights in your work, talent, and brand.

If you have a hit song that everyone loves, but everyone is free to use it in any way they want without compensation and/or without restriction on the scope of usage, then there is either no incentive to pay for it in the future, and in some cases, very little value in wanting to use it in the first place. Think about it.
So kudos to these artists who wasted NO time enforcing their rights in their music. These are artist who understand the value of their work…and the critical importance of protecting that value.
To the rest of you, if you want to use someone’s copyrighted work or trademarked symbol or their name, image, and likeness, you must get permission! And Mr. Gingrich, politicians are not exempt!
